The New England Legal Foundation will be hosting its fall breakfast program on November 20th in Boston, MA. Pauline M. Booth, Managing Director in the Disputes and Investigations practice will participate as a panelist to discuss “International Arbitration: Hot Topics and Smart Contract Terms.”
The panel will provide practical advice for the negotiation of effective terms for dispute resolution by international arbitration. They will discuss fundamental, strategic issues such as the choice of institutional or ad hoc arbitration; venue, with attention to the strengths and weakness of major and emerging centers of arbitration; the conduct of an arbitration and recent processes seeking to harmonize cultural differences; the number, qualifications and selection of arbitrators; the rules of law governing the agreement and subsequent disputes; provisional and conservatory measures; appeals; and multi-tier dispute resolution clauses. The panel will also address different approaches to expert testimony and the quantification of damages in international arbitral proceedings.
